Legal Question in Personal Injury in Ohio
Car Accident
I was in a car accident. The 2 year period is up in May, 2000. I have a laywer. He keeps
telling me that the other company will settle out-of-court before the 2 year period. He has
not filed this case with the courts. He claims I must pay him $6K before he can file with
the court system? Shouldn't he have already filed the case with the court so the insurance company has to pay by the date? What should I do?

Dear Sir or Madam: You must file your claim with the proper Court within two years after the date of the accident, or your claim may be forever barred! Your attorney is guilty of gross misrperesentation and malpractice. Find new counsel, discharge your present counsel, and file your case without further delay. Do not rely on the representation that the insurer will settle and pay before the statute of limitations (time) runs out. The insurer is counting on your own negligence and if you fail to file timely, you're through! Good luck. J.
