Legal Question in Personal Injury in Ohio

Personal Injury commited by juvenile to another juvenile

Is there a case if another juvenile assaults another juvenile on school grounds during school hours resulting in a broken collar bone to the victim? Also, how much responsibility lies with the school knowing that this 'bully' has previous reports made on his behavior? Can the school be liable as well as the parents of this child?

To expand on Atty. Burke's response, you would have a claim against the juvenile who commited the assualt. You might be able to make a claim against the parents alleging that they failed in their duty to control their child and protect the public.

Generally, you cannot sue a school district pursuant to a doctrine known as sovereign immunity. There are exceptions depending on where the assault occurred, how much notice the school had, etc. I suggest you consult an attorney to review the facts of your case to determine if an exception exists.
