You should have been contacted by the insurer of the person who hit you. Usually, in rear-end collisions, the liability is conceded by the person who hit you. But, if they contest the liability, you may need to sue the other driver. If you win, you can file a supplemental action against the other driver's insurer to make them pay the judgment.
