reopen a case

can I reopen a settled case because of previously unknown injuries?

Usually the release that you signed contains a clause that states you are settling all injuries, whether known or unknown. It is difficult to reopen a case unless there are exceptional circumstances.

The easy answer to your question is "no." Under most circumstances the insurance company who pays requires that a release be signed that clearly indicates that all claims are being settled.

I can not say that you definitely are out of luck without more information. You should talk directly to an attorney. It may be that there are circumstances that would allow you to reopen the case.
