Legal Question in Personal Injury in Ohio

who is responsible?

My daughter was in her classroom and her friend came up to her and my daughter pushed her back toward her seat. The girl came back and said ''that was fun do it again''. My daughter pushed her again only this time stepped on the girls shoelace and she went right to the ground and broke her front teeth. My daughter was given 2 days of in-school suspension.I called and spoke to the principal and she told me that the girls mom is upset because they are not working right now and have no dental insurance and the principal told her that maybe we would help pay from our homeowners insurance! I do not feel we should be held responsible! It was an accident and their daughter was at fault as well! We got a letter from an attorney staying they want is to pay for the dental bills and want is to contact our homeowners ins. Am I liable in this situation?? Help!

The best thing you can do is to contact your homeowner's insurance and send them the attorney's letter. If there is potential coverage under the homeowner's policy, you need to put the company on notice of the potential claim. The insurance company should be able to advise you whether the policy provides coverage and if it does, the insurance copany will take over the handling of the claim. If you do not notify the insurance company, they may not help you because you did not provide them with notice of the claim. Please do this as soon as possible.
