Legal Question in Product Liability in Ohio
I am aware that a malpractice law suit must be brought by the administrator of the deceased's estate. Does the same apply regarding a product liability law suit?

If the deceased person is the one who was injured, a survivor claim can be brought by relatives to recover damages for injuries the deceased person suffered. This does not have to be the estate administrator or executor. In addition, recoverable damages for a survivor claim and wrongful death claim are different. Again, the survivor claim is for the deceased person's injuries. The wrongful death claim is for family members' damages resulting from the death, i.e., loss of inheritence, funeral, burial, etc. It's best to bring both claims to maximize your recoverable damages. Please call me if you would like to discuss.
