Legal Question in Real Estate Law in Ohio

Loss of Land

My elderly mother's neighbor has been mowing a large piece of her property for about 3 years now. Is there some loophole where he can obtain ownership by caring for the property? He has mentioned interest in owning it and has actually told other neighbors that he owns it. I am concerned my mother may lose this land. Thank you.

Re: Loss of Land

For yor neighbor to claim ownership by adverse possession, he would have to have exclusive, continuous use of this piece of property for 21 years. As long as your mother continues to use the part he mows, he can not claim exclusive use. Make sure you tell him to stop in time if you are comcerned.

If he is using and mowing with your mother's permission, his possession is not adverse and he can never claim ownership.
