Legal Question in Real Estate Law in Ohio
Negligence and storm-toppled tree
A storm uprooted our 40-ft. tree. It was securely caught by similar trees on adjacent back neighbor's lot. It seems very secure and only neighbor's woods are in fall path. However, my side neighbor mentioned his concern that further falling might graze his back fence. Am I considered negligent if I leave it as is? If, somehow it does fall to the ground in the future, would my homeowners insurance cover my liability--would negligence be a basis for my insurance to disallow coverage? What possible ramifications should I be aware of?

Re: Negligence and storm-toppled tree
First, you should call your insurance agent and report the damage. Second, you should at the direction of your insurance company have the tree professionally removed. You are responsible for your trees and the damage they cause. Doing nothing is not a good option.
