Legal Question in Real Estate Law in Ohio

property and medicaid

My husband was diagnosed with lung and brain cancer and is no longer able to work. I have quit my job to take care of him as he was given six months to live. We had no insurance and have applied for medicaid and was turned down because the only asset that we have is 9 acres of land we own in KY. Is it legal to transfer this land to a relative for $10.00 an acre to get it out of our name in order to make him elligable for medicaid as I am afraid that without insurance he will not get the care that he would with insurance. Or if we did do this would it make him completely in elligable for medicaid.

Thank You so much

Margaret

Re: property and medicaid

If the transfer is for less than fair market value, it will generate a period of ineligibility that will be longer than your husband has left.
