Right to Sue over rent payments

My sister was notified that she is being sued by her roommates for not paying her rent. However, her rent payment is not due until the first of September (tomorrow). Can she be sued for failure to pay rent if she has not yet failed to pay? She will pay her rent tomorrow, but how can she be sued right now if she has not yet failed pay? What legal steps should she pursue?

I wouldn't worry until she actually gets served with the papers. If all that is in question is September's rent, it will be moot by the time she gets served.
