Legal Question in Real Estate Law in Ohio

tenant's rights?

My husband and I rented a house in January of 07. The landlord lived in the house before we did. The house has tons of unfinished little projects that he promised to fix. I have taken on a few myself, though I know I wasn't obligated to, but that's just me. I like to live in a nice place. The biggest problem is in the downstairs bathroom. The landlord just put in a new vanity, toilet, tub, and tile before we moved. The work was unfinished as far as I'm concerned. My husband had to fix the drawers on the vanity. The faucet is not secured to the sink and worst of all something is leaking. The tiles are wet and make ''squishing'' sounds when you walk in their. I can't put any rugs or towels down as they get soaked. It's starting to smell like mildew and the water is dripping down into the basement, where black mold is growing on the ceiling from it. We think it's the toilet, but we're not plumbers. The landlord feels she should fix it. We have been up to two weeks late on our rent, but have never missed a month. The landlord uses that against us and feels we have no ''beef'' with him as to fixing this mess. He feels it's a small job and that we should do it. We feel it's unsafe for our kids and dog. Please advise. Thank

Re: tenant's rights?

Your lease controls who is responsible for minor repair issues. Ohio law requires a landlord to maintain plumbing, hearing and electrical systems, and this obligation cannot be shifted to a tenant.
