Legal Question in Wills and Trusts in Ohio

Codicil to will.

My aunt has passed and we are filing her will. We suspect there is a codicil but the attorney has been uncooperative in providing us with a copy or an original. Does this information need to be mentioned when filing the will for probate?

Re: Codicil to will.

The codicil is apart of the Will, and it must be filed with the Will. The attorney should not have the original codicil, however, he may copy. If you believe the attorney has the original, you can ask the court to order him or her to produce the codicil.
