There are two basic and some what related reasons to contest a will. First, you can attempt to demonstrate that the decedent was incompetent at the time the will was executed. Second, you can attempt to demonstrate that the decedent was subject to undue influence when drafting his will. Several factors, too complicated to list here, must be present to demonstrate undue influence. Our office has been successful in contesting wills.
