''Estate question''
My fiance's sister was killed by a co-worker and the husband of the victim and my mother in law are suing the co. she worked for. There is an estate set up in the husband's and the mothers name and I wanted to know if, in this situation would the estate be divided equally? The husband initiated the lawsuit.

Her estate will be distributed in accordance with the terms of her will, if she had one. If there was not a will, then her assets will be distributed in addordance with the provisions of the Descent and Distribution statute, which is to long to discuss here.
The claim filed by your mother-in-law and brother-in-law in all likelihood is a wrongful death claim. As the brother of the victim, your fianc� has a claim for the loss of his sister.
