Legal Question in Wills and Trusts in Ohio

Probate of Wills

I am the executor of my father's will. He passed away on October 10. All those mentioned in the will are his immediate relatives; ie, my two sons and one dauther and myself. The only property we have is his manufactured home, his car and an IRA account that he has. Does the will need to be probated or can I just distributed the property. It is evenly divided four ways.

Re: Probate of Wills

The IRA does not need to be probated because he probably named you and the others as the beneficiary. You can claim the IRA by submitting a certified death certificate to the IRA custodian. Unless he designated a beneficiary on a title, you would need to probate the manufactured home and the car and file the Will with the Probate Court.
