Legal Question in Workers Comp in Ohio

injury at work...

I had injured my foot at work a few months ago, and had an altercation with the owners due to it. They never asked if I was seriously injured, needed medical attention or offered a form for me to fill out due to the injury. I kept my cool, swallowed my pride and went on with my day. The injury at first did not seem serious, but since then I have seen a podiatrist and he determined I have a fracture that may need surgery. They know I have seen a doctor, and know the extent of the injury and show no concern...going as far as to say, ''if it REALLY hurts that bad, just go home!!'' I am going to file through workers compensation, but was wondering if this may be a case that I have jurisdiction to pursue something further?? Please let me know if you could help, cuz it's driving me crazy!!

Thank you!!

Re: injury at work...

You are limited to pursue your workers's comp claim

Intentional Torts are situations where your injury

was caused by something the employer knew or should

have known would harm you. The insensitive response

from the employer while inexcusable is not a basis

for a seperate cause of action outside your admin-

istrative remedies with the BWC and IC.
