Legal Question in Civil Rights Law in Oklahoma
June /5/2010 I purchased a new car from dealership.Traded in a 16 foot pontoon boat as well as 96 car. Both were owed on. Signed all paperwork, They said would be financed through GMAC. Drove car off the lot.
Second week of june paid salestax and purchased tags for car.
Third week of june contacted GMAC questioning why i had never recieved anything from them regarding payments. They said we are sorry we have not financed anything for you. Call back next week. Called Dealership they said they had already sold my boat and car.
June 27th recieved letter from GMAC stating they could not finance my car unless terms were modified.
Called dealership said yes yes its financed just give it time.
First week of july called GMAC said they have not financed my new car. Called dealership they said we will check whats going on and call you back.
July 11th recieved letter from GMAC stating they could not finance car unless terms were modified. Called dealership they said oh yes its through GMAC you will be getting something in mail.
July 16th called GMAC they advised I take the car back to dealership. Dealership said oh we just need you to sign a diffrent contract. I gave dealership the title and keys and told them I was not signing a new contract. The car is setting in the back of the lot.
July 31st I called GMAC they said yes we now have approved your loan and no your payments arent behind the dealership paid your payment. Dealership threatened me with ruining my credit they have called me everyday for a week demanding I sign a new contract. What are my options at this point.

Do not sign another contract under any circumstances!!! Particularly, if all the above occurred and they are demanding that you modify the current contract signed by the dealership and finance company. You are protected under disclosure laws and Good Faith contract laws. Get an attorney!
