Under-the-table contractor built deck

We contracted a deck to be built from a local hardware chain that does home improvements. The person we contracted with proceeded to build our deck on his own time, cheap materials, and asked us that we pay him. Our deck is now falling apart, is not sealed yet, and was extremely badly built. Do we have any recourse against the company we assumed we first contracted with ? This company was sending us bills and the contractor was saying ''Oh, I'll take care of that''.

The person that you originally contracted with is responsible for the deck, regardless of who built it as their subcontractor. Unless the deck was extremely expensive, i.e. greater than 5000.00, you can have recourse through small claims court in your jurisdiction, by suing the original vendor who you contracted with to have the work performed.

The limitation on damages varies state to state, since I am not licensed in OK, I do not know the limit. Filing suit is always one way to get someone's attention when they have repeatedly blown you off.
