Legal Question in Family Law in Oklahoma
An attorney was hired for custody of a child doesn't return calls or provide legitimate assistance, he was paid a retainer and then didn't even file the motion for a hearing..my friend had to file it as the attorney claimed he was busy, since hiring this attorney in January 2012, he has not returned calls and seeming avoids e-mail requests. My court date is this month on the 22nd and we haven't heard back from the attorney since July. The ex husband in the suit has several VPO's filed on him due to his violent behavior and has beaten, pulled guns on my fiance, let the minor child get molested while in his care, stalked and harassed many people in our social life, and limited visitation time under the guise of events and tutoring for the minor child
.while taking everything away from the minor child as punishment for made up issues. This child wants to live with me and his mother and is and has been subjected to injury and abuse under the care of his biological father. My attorney won't return calls and has all the documentation i need for this custody hearing...what can i do about this and my attorneys failure to properly represent and help us ?

There are a couple of things you might try. I would send him/her a certified copy of a letter stating your concerns. With that letter I would copy the bar assoication. It may the attorney has a reason for not getting back with you (health problems etc.) If that fails to produce any results you always have the right to fire a lawyer. It is short notice but a new attorney could get your file and information and if necessary ask the court to continue the court date.
