renting with out contract

I made a verbal agreement to a

cousin to pay monthly into a set up

account on my deceased mothers

house. When the account reached

$3000.00 I would turn the deed of

the house over to him. He has made

no payment since 6-2004(this is Feb

2008) so Jan 1st I sent a registered

letter to him stating that he has till

Feb 15 to make a payment of

$125.00 a month(and pay back

taxes, which I have been paying) or

vacate the house. He has turned his

phone off so this is the only way of

contacting him. He has made no

effort to contact me since and he has

a week left to pay. My family thinks

that we will have to do it legally

through an attorney to kick him out

but there was never a contract, he

could be a squater for all anyone

knows. Do I have to go a legal route

or can I just ask him to leave. The

deed is in my name.

Re: renting with out contract

you can ask him to leave all you want but the only legal way to force him out if he refuses to go is to follow the eviction procedures. Send him a notice to vacate and then file eviction. I agree it would be advisable to hire an attorney to handle it for you.
