Theft II (theft of less than $750 and more than $50)is a class A misdemeanor. The maximum penalty is one year in jail and a $6250 fine. If convicted, your sentence is dependant upon your criminal history and the circumstances. Some counties have a theft diversion program if you are eligible. It may also be possible to do a civil compromise and avoid a conviction if you do not have any priors.
