I have been divorced 16 years my son of 17 moved out of his mothers house and into my home, does she have the right to retain his birth certificate?

Yes, she has the right to retain his birth certificate. But, of course, all you have to do is contact the Vital Records agency of the state in which the child was born and you can obtain your own copy of your son's birth certificate.
