Legal Question in Family Law in Oregon

My mother died last July in Oregon. The estate is left two me and my brother. He is the executor as I live 3500 miles away. He is refusing to sell and finially put it on the market at double the realistic price he said to shut me up. He has not emptied the house, to get it ready to sell, has not cut the grass which is about 4 feet high, saying he wants to wait until a better market. However, we were left with bills for the estate now almost $100,000. After agreeing we would communicate by email (in front of his attorney), he still refuses to do so and I just found out that two weeks ago pipes burst and damaged two floors of the house and he never notified me. Should I petition the court to have him removed as executor, as to be joint, or ask the court to intervene in some other manner?

Yes, petition the court to make you the executor. Also, ask the court to order that the house be cleaned up and sold as soon as practical. Submit pictures of the water damage.
