Back rent and wage garnishment

My tennat's are almost $3000 behind on rent. If I evict them, can I file a wage garnishment to recoup the money owed?

You cannot get a judgment for back rent in an eviction proceeding. Eviction proceedings only deal with possession of the property, they do not deal with any money issues.

You have to sue the tenants separately for the back rent (since it is only $3000, you can use small claims court). Once you get a judgment in small claims court, only then can you garnish the ex-tenant.
