Legal Question in Workers Comp in Oregon

Question about Workers Compensation Insurance Carrier

I am currently on workers compensation and am under doctors orders not to work. I was let go by my company because i filed a complaint against my supervisor involving harrasment, working without breaks, and because I demanded to be paid back wages because I was being taken advantage in regards to wages (I was a salaried supervisor). My company found that I was right and was owed for 5 years worth of back wages. I signed a non-disclosure agreement and agreed to my dismissal. In return I was awarded the sum I requested. The day before I sent my complaint to the president, I filed an aggravation claim for an injury I sustand at work in June 1999. At the time my doctor put me on light duty. My company said they did not have anything light for me to do so my termination was effective immediatly (21 Feb 99). My insurance carrier has been giving me the run around about disclosure of my records. I can't get them to tell me whether or not I have legal access to their records pertaining to my case. Please let me know any applicable info. Thank You!

Re: Question about Workers Compensation Insurance Carrier

Write a letter to the Workers Compensation Insurance carrier (keeping a copy for yourself) with your name, claim number and date of injury in the reference portion of your letter asking for all documents medical and otherwise which in any way pertain to your claim, including but not limited to medical, investigative and personnel materials. State that you have asked for these records in the past and expect to receive them within no more than 15 days. This information is yours to recover and within 15 days under Oregon WC law.
