If a subcontractor is injured on the job is the individual that is paying the subcontractor liable for workers compensation? What is the workers compensation laws in Oregon? A contract was signed by the subcontractor stating that she would be receiving payment as a subcontractor for her services.

If the subcontractor is an independant business person who contracts to work for a variety of contractors or other entities, then there is requirement that the sub carry their own WC coverage. The problem arises if the subcontractor is a single person who dosn't have WC coverage and is clearly an independent businessperson rather than an employee of the contractor. What names people give each other are less important than the facts. In some settings the general contractor on a construction site or similar job might be obligated to carry WC for his subs. as well as his own employees
