Child Custody Law

What does Joint Custody mean in PA? Is there such a thing as 100% joint custody? Or is one parent always designated as the custodial parent in the eyes of family court?

Joint or shared custody exists..Each parent has an equal right to the children. Mathematically this may not mean 50%, but close. Shared legal custody is almost always the case. The days of onee parent having a predominant right to most of the custody has gone by.

There are two types of custody, legal and physical, legal involves decision making and physical is with who the child lives. Physical can be 50-50. Legal is usually joint.

There are differentt classifications of custody: 1) Legal Custody: The legal right to make major decisions the best interest of a minor child, including but not limited to, medical, religious and educational decisions. 2) Physical Custody: The actual physical possession and control of a child. 3)Partial Custody: The right to take possession of a child away from the custodial parent for a certain period of time & 4) Shared (joint) Custody: An order awarding shared legal or shred physical custody or both of a child in such a wat to assure the child of frequent and continuing contact with and physical access to both parents.
