catering drivers

I have a small business of delivering food to businesses. My drivers wear uniforms and drive their own cars. Can I legally tell them they are responsible for their own insurance? If there is an accident their insurance would cover as much as allowed, then my company's insurance would cover the remainder on the other car but not cover any bodily injury

You asked about insurance with regard to persons driving their own vehicles for business.

Each vehicle in the state is required by law to have insurance coverage. the question you need to ask is whether the coverage your drivers have provides sufficient protection. Probably not.

Insurers rate vehicles and drivers based on assumptions. A basic assumption is that a vehicle will be used as a personal vehicle and not used for business (or racing, etc.). Your drivers need to inform their insurers that they will be using their vehicles for business purposes in order to ensure that they are properly covered. The last thing you want is to have an insurance company have a valid reason to deny based on a condition for which you could have controlled.

Work with your insurance agent to come up with a solution so that your drivers can amend their policies to include their use of their vehicles for business without getting hit with huge premium increases.

You might want to also sit down with an attorney and discuss solutions for the full scope of risks to which your business is exposed.
