Legal Question in Business Law in Pennsylvania
Church By-Laws
Our church want to make some changes to the Statement of Faith section of our Constitution, but the constitution says ''SECTION 3. The provisions of Article III shall be considered as fundamental, the basis upon which this Church is founded, and shall never be amended.'' What can we do?

If an amendment is drafted to indicate that the parties clearly intend to amend the noted section, despite the prohibition on amendments, it should be effective, however I would need to review the Constitution in its entirety to give a more determinative answer.

It seems to me that if there is a procedure for amending the Constitution then you would have to amend Section 3 in order to amend Article III.
