no compete agreements

I had to sigh a non-compete agreement to get contract work with an IT consulting company. I need the work. I have been planning for two years to start my own IT consulting company also. I was originally told that this non-compete agreement was only to protect the guys customers, now he's saying I can't start my own business. Is this agreement binding? I have proof that I was working on starting up my own business for two years. Also this guy I work for as a sub-contractor is just starting up his business.

It is difficult to advise you without reviewing the agreement and the circumstances surrounding its execution. Agreements to restrict competition are enforceable if they are reasonable as to time and geographic area. I suggest you have the situation reviewed by legal counsel.
