I contracted an on-line company for 12 personal training sessions (received 1 thus far) The process is for the company to obtain a trainer in my geographic area and based on my availablility, the trainer is supposed to contact me to schedule sessions. Six trainers have been contacted on my behalf and have not returned the company's calls nor have contacted me. I have called the company everyday for 21 days in an effort to obtain a trainer to no avail. I have been charged for seven sessions ($390)thus far and have requested a refund for $330 since a trainer has not been provided to me in 3 weeks. The company is only offering a $76 refund (stating there is a 20% cancellation fee). Based on my conversation with company personnel that claim to be Director of Client Services, Director of HR, and Office Manager there appears to be significant credibility issues with representatives of this company. It is clear to me the company has not fulfilled the service intent of this contract. What recourse, if any do I have?

Assuming that there is a written contract, it really depends on what the contract says. I suggest that you read through the contract to determine under what circumstances one can cancel the contract. If the company in your opinion is not fulfilling its obligations then either hire an attorney or proceed to small claims court.
