Legal Question in Business Law in Pennsylvania

Definition of Contractual Capacity

Does the term contractual capacity go beyond insane persons, Intaoxicated persons, and minors. Can the term also be applied to those persons that do not have the authority to enter into a contract on the behalf of another?

Thank you

Karen

Re: Definition of Contractual Capacity

A person who does not have any authority or apparent authority to act as a party's agent can not bind another person in a contract. That being said, the circumstances surrounding the contract should be reviewed by competent legal counsel in order to evaluate any liability. Gerald Hershenson Esq. 215-579-9390
