This follows the old law school answer of,"it depends". How long ago was the money 'borrowed'? What do you mean by it was, "borrowed" on your credit card? That phrase is a contradiction in terms--the card is in your name, to be signed by you. Do you mean that he forged your name without your authority? That would likely be not only recoverable by you, but criminal behavior by him as well. If, however, he asked you to take out a cash advance (in which case you signed for it), then the wording surrounding the transaction becomes important; why did you do it for him? Did you do it just because he was your boyfriend, or did he make a legally enforceble promise to pay (a contract) to repay the money? If you did it to be nice, then I am afraid that the law offers no remedy. If, however, you have a valid contract with him (you will likely have to talk to a lawyer further to examine the details of your transaction with your ex-boyfriend so that you can see if you have a contract, verbal or otherwise) then you may be able to pursue him for the money. However, be aware that the statute of limitations is always ticking; I don't know how long ago you made this transaction, but you should not wait long to seek an opinion. The longer you wait, the more likely that key information is going to fade from memories, and the more likely that your ex will spend what is left of the loan. Depending on the amount loaned, this may be something that you would be able to handle in small claims court, or it could be a larger amount that would have to go to arbitration/mediation or civil court (Common Pleas court).
