Legal Question in Business Law in Pennsylvania
I recently discovered an incorporated company using the exact same incorporated company name as mine. I have been incorporated for 5 years and have been incorporated on recently. I am in the U.S. and they are located in Canada. Is there any legal recourse between countries for two corporations with the same name? Thank you for your time. Brian

As a Franchise Attorney I can only say the following. It all depends on how the parties have protected their names (as registered trademarks or service marks - not just corporate names), where they do business, type of industries and consumers, etc. Consult with a good trademark or franchise attorney in your area for specific advice.
