Is it legal for my employer to install surveillance cameras with audio recording through the building and in the lunch room areas?

Good question. The Pa. Wiretap Law is very strict. It prohibits a party from taping a converation without the consent and knowledge of the other. It is a criminal offense to do so. On the other hand, If, you consent to the taping, or if you are in an area where you have no expectation of privacy, it is probably OK. On the other hand, your private conversations with a co-worker are no business of your employer. Also, unless you belong to a Union, you are an at-will employee and the employer can fire you for just about any reason. Your options as to what to do are somewhat limited. You can report this possible violation to the police, but it is up to them to pursue it. You can sue your employer for invasion of privacy (one of the few exceptions to workers comp), but how much is that worth, and will you able to afford attorneys fees that might be charged. If enough of your co-workers are willing to get involved, then an attorney very well might take the case on a contingency basis. The statute of limitations for a civil invasion of privacy suit is one year.

How do your co-workers feel about this. If enough of them are willing to participate, it is cerainly advisable to meet with a lawyer, especially one who has hndled invasion of privacy cases before.
