can a pedestrian sue if they were hit while trying to cross the street in a non cross walk area/J walking, suffering non threatening injury ,if a person was backing into a vacant parking space. Who is at fault?

Your case is weaker if you were hit while walking in the street outside of the cross walk area. That, however, does not mean that you can't sue. The person backing up has a duty to watch where they are operating their vehicle. You would likely be deemed partially responsible but may still be able to recover money. I just resolved a couple of cases very similar to this for a reasonable amount of money so it can be done.
