accused of shoplifting

my girlfriend and I were grocery shopping at Shoprite. mygirlfriend was drinking a redbull she brought from home. as we were paying, an LP agent approuched us and accused us of stealing the redbull. harrased and embarresed us. after talking to the manager, he told us that shoprite doesnt sell redbull.

whether this is an actionable case depends on the facts was your girlfriend taken to a romm and questioned preventing her leaving. Were the police caled?. Did your girl friend suffer any emotional distress requiring her to seek medical treatment. Were there other people in ear shot of the acqusations. How long ago did this occur. You may have an action against the shopowner for false imprisonment. Under the shopkeepers' privilege, they should only be able to detain you for a reasonable amount of time with a reasonable basis to do so.
