When someone passes away is their family obligated to pay any consumer debts outstanding

You asked about payment of estate debts.

The estate of a decedent is responsible for all debts of the decedent. If the decedent's estate is greater than the amount owed in debt then that amount is probated according to the will or the laws of intestate succession. If the debts exceed the estate then the debts are generally extinguished UNLESS a survivor guaranteed or co-signed for the debts.

There are priorities with distribution of a decedent's estate but it is important to know whether the property is passing through the estate. If the decedent had life insurance payable to a named beneficiary that doesn't go through the estate. If the decedent was married and owned property in a tenancy by the entireties (with their spouse) that doesn't pass through the estate. It is best to consult an attorney even if this is a small estate.
