Insurance problem

We recently had a fire, cause lightening. Our garage burnt down and it also knocked out my computer, dsl and phone line. A computer company came and picked up my computer 7/02/07. After numeruos calls, they still did not bring back my system nor contact my insurance company though they promised my system back three weeks ago. The Motherboard onboard LAN was hit. They wanted to ''bandaid'' the system with a PCI card for 13 dollars BUT, I have replacement value on our homeowners insurance. I cant not get the company to settle this with the insurance company ''ERIE'' and also can not get my claims rep. from ERIE to call me back. What should I do? Go to the local magistrate? This should of been all settled within a week after they picked it up and found the problem. I don't pay for insurance and extra money for replacement value to have a system hit by lightening to get jerry rigged then end up having it die down the road. My insurance REP did agree on replacing the system. The computer company told me 300-400 to replace the processor and motherboard that is now 2 years old. Replacement value means to have it replaced now with a equal system to that one in its day not going out and telling me 3-4 hundred for old parts. thank you

Though I cannot speak to exactly what replacement value your policy provides (that's a detailed question involving the precise wording of the policy), I can tell you that your claims representative should be in contact with you to tell you their position either way.

Your next step should probably be to send a letter, certified mail, to the claims representative explaining your frustration and telling them that if they do not get back to you and approve full replacement of your items that you will file a complaint with the Better Business Bureau (http://www.bbb.org/) and with the Pennsylvania State Insurance Department (http://www.ins.state.pa.us/ins/cwp/view.asp?a=1277&Q=526760).

The squeaky wheel usually gets better service on their policy.
