Legal Question in Credit and Debt Law in Pennsylvania
A husband died he owes money on a truck wife doesnt want truck can she have it repossessed without the bank coming to her for the money

Yes. Provided that the truck is just in the husband's name and the loan is just in his name. in such case, the wife can tell the lender to come and get it. However, the lender still has a claim against yjhe husband's estate for the amount remaining on the loan plus any collection costs and less any proceeds derived from the sale of the car. If the decedent husband has no other assets, this option may make sense. However, repossession sales never bring in much money and the wife would be better off trying to sell the truck for the amount that is owed unless more is owed on the truck than its worth.
I would suggest that the wife speak first to a probate attorney before she starts disposing of assets. She can then better assess the situation.
