Payment of debt

I paid for services over 2 years ago. They never cashed my check, I thought it was cashed and long gone. They contacted me that it was never cashed and now want the money. I told them I would now need to pay them back in payments can't afford to pay it all back at once now. I gave them a partial payment and it took them over 2 months to cash that check. Just received a notice that he is now going to tack on legal fees and interest on the outstanding balance. Was it my fault that they didn't cash the check from well over 2 years ago. I am still liable for this debt, can he access legal fees and interest now?

You are only liable for legal fees if your contract specifically says so.

Regarding the non-cashed check,I would argue that you are not responsible for interest as you tendered the check 2 years ago. Their failure is not your responsibility. The only question is proof. Can you prove that you gave them a check at that time?
