Legal Question in Credit and Debt Law in Pennsylvania

Seizure of property...

I lost my job & was unable to pay a credit card debt. A civil suit was filed at the local magistrate and I did not show, for I knew I owed it. A judgement was placed against me. I received a letter from the prothonatary office of the judgement/filing. Now, I rec. a reg. letter from coll. agency stating they are going to seize property unless debt is pd. Can they do this?

Re: Seizure of property...

Yes. You owed a debt and the collection company went about collecting that debt. They proceeded to court and you didn't show up. So you defaulted. You could have presented a case, but when you didn't show up you lost without an at bat.

Either make arrangements to pay the debt, surrender property to pay the debt or seek other relief, such as bankruptcy. Otherwise, prepare to have your property siezed to satisfy the judgment debt. This may include seizing bank accounts, personal property such as a vehicle or certain household goods or even real property.

Depending on the size of the judgment and your ability to pay you should seek counsel immediately to either set aside the default or make arrangements.

Good luck,
