simple assault and harrasment

my fiance and i got into a fight at a party i gave him a black eye we were both drunk. we went home and i wanted to leave his mom called the cops because she didnt want me to drive drunk they arrested me and charged me with simple assault and harrasment. it was a silly fight the first time i drank in awile we are getting married have a child and live together he called and said hes not pressing charges and the magistrate refuses to drop them they charged me with simple assault and harrasment. she supeonad my fiance to testify againt me what can we do?

Your fiance has to show up at court because of the subpoena, but he doesn't have to say anything. If he shows up and says that he doesn't want to testify against you, the charges should be dropped.

The Judge could compel your fiancee to testify. If you got married before the hearing your fiancee could assert a marital privilege.
