wrote a check for a vehicle but check didn't clear returned vehicle to dealer but still wants to charge me for fraud have bank statement that shows I had well over the amount the check was written out for in account that day are they in the right

Theft by deception seems a bit over the top for at worst is a bad check charge. For bad check you are allowed to make the check good. These folks sound like bullies. You should consult with a lawyer.
