Legal Question in Discrimination Law in Pennsylvania

Is this discrimination?

Recently the deptartment that myself and another gentleman worked in was closed. We were both at the same job grade level. There were two jobs available in another department, that of a manager and an assistant. My male co-worker was offered the management position and I was asked to take the assistant job. In doing so I was required to drop two levels in the job range and lose stock options. My salary is also now capped due to the level that I was previously at. I have been with the company for 15 years and my background is directly associated with the new position. Several of my years with the company were in a management role in the area where I have been recently relocated to. My male co-worker has been with the company for 7 years and his experience is in a different field. I have maintained excellent reviews during my time with the company and am now teaching my co-worker how to do the job. Is this discrimination?

Re: Is this discrimination?

Your situation may or may not constitute discrimination based on gender. More facts and information would be necessary. On the surface it appears you have more experience in the management position then your co-worker. it would be informative to know whether your company has a prior history of favoring male employees over female employees for these type of positions. You also do not indicate your age or that of your co-worker. It is possible that in addition to possible gender discrimination there may be age discrimination.. You should discuss the matter further with an employment law attorney.
