dui arrest

my husband is facing what they are calling his third dui, they are using conviction date and arrest day to come up with the 10 years. is that right? it seems they should use arrest/arrest date or conviction/conviction date?

The way the statute reads the conviction date of the prior arrest is the relevant date. A third offense is a very serious matter under the 2003 law and you really do need to discuss this with an attorney.
