Legal Question in DUI Law in Pennsylvania

My 18 year old son was pulled over. He admitted to drinking 2 beers. Breathalizer was .09%. They took him to hospital for bloodwork. DO I have the right or does he to know his BAC? WHo would we call to ask?He drives to 2 jobs to support his college tuition. WIll they allow him to drive to school or work only? HE has no prior offenses or tickets. Thank you.

He has the right to know the alleged BAC from the hospital blood test, it should be included within any paperwork received in regards to a DUI charge. If your son is convicted, pleads guilty, or even accepts ARD, he will receive a license suspension that is what we refer to as a "hard" suspension, meaning that he is absolutely forbidden from driving anywhere. Well, there are going to be some special problems because he is underage AND had ANY amount of alcohol. I'm assuming that when you said his BAC was .09 that was on the FIELD tester, and not a breathalyzer at the station. He does have a right to the results, but not necessarily immediately after the stop. You should talk to a lawyer as soon as possible. Feel free to call our offices to discuss.
