Legal Question in Family Law in Pennsylvania

Does he get 1/2 in divorce?

I reciently came into some money due to my mothers passing away. My husband and I decided to pay off our mortgage. I would like my name added to the deed. (I filed for bankruptcy 13 yrs ago, my name is on NOTHING) My husband told me that he will not add my name because he seems to think that if we get a divorce that he will have a better chance of getting the house from me if my name is not on the deed? This sounds crazy to me! I would have not used my inheritance to pay off our mortage if I knew that he had even thought of divorce, and certainly not to get a divorse so he could try to get the house from me. Would he actually get 1/2? I also payed off ALL bills, and put 1/2 down on a NEW truck for him. Was I being stupid? I am so confused.

No he will not get the house. Pennsylvania is an equitable distributaion state. If the parties cannot agree on a division the Court will inquire into the parties income potential and various other factors to divide the property. The fact that you used the inheritance to pay off the mortgage is very beneficial. Collect all you documents to prove that you did. A lawyer early on in divorce proceedings can be a major plus in a case like yours. I offer free consultations.
