change of name of a minor

My brother has 1 child with an ex girlfriend. He has regular visitation and pays child support weekly. The child has my brother's last name, but his ex keeps threatening to have it changed to her last name. The child is 7 years old. My brother cannot afford a lawyer but his ex can. Can she have the child's name changed?

She would have to file a Petition with the Court for an Order approving the name change. Your brother would have the right to contest the Petition.
