Either state. The process will be simpler if he does it in Kansas. However, this may not be convenient. Why is your son not contacting lawyers? Many lawyers do nto do call backs on grandparents calling for out of state children.

The appropriate jurisdiction for custody cases is largely based upon the residence of the children, but there are excpetions. This therefore is a matter which will depend upon the details of the case. For example, if the claim can be made that one parent has taken the children to another jurisdiction in violation of a custody order of a first jurisdiction, he may not be able to obtain jurisdiction in his new place of residence. Because of the complexity of this matter, it is important for your son to consult with an experienced domestic relations attorney.
